Conveyancing is the process of transferring the legal ownership of land or property from a seller [vendor] to a buyer [purchaser].
 

Conveyancers are specialized only to do conveyancing work.

 

Lawyers do conveyancing work as part of their practice/s.

  • You have realised = You will become an actual property owner.

  • Buying/ Selling a home = seek out the advice of a conveyancer.

  • Home sold/ bought via

    ​   - private sale
       - auction or
      - through a real estate agency 
    The vendor/buyer [your] responsibility is to hire a conveyancer.

  • Something goes wrong/ The process is not completed properly = Your neck on the line.

  Possible pitfalls to keep in mind

   Problems in the way for you to buy a home: 
 

  • A lost title = Conveyancer is to ensure the title on the property you’re purchasing is true and correct before it is transferred into your name properly.
     

  • Title issues
    - Title is lost
    - Measurements of the property do not match current title on      the home

     - Discrepancy in the former owner’s name.
     

  • Conveyancer sorts out all problems, but  
     

  • You must read
    - all title documentation provided to you
    - check and re-check your name on the new 
    title
    take note of all measurement details.

    Constructions not approved by council
     

  • Structures attached or not attached to the home:
    - extensions 
    - pergolas.


    If constructions exist,

  • Your conveyancer will require:
    - you purchase the property conditionally on the council              clearance of these construction/s or

    - your conveyancer can write into the contract of sale [COS]        that a lower price is to be negotiated to cover the cost of you    pursuing the council approval of these illegal constructions      at a later date.

  • If you fail to recognize these structures,
    - you may not be able to sell the property at a later date and
    - could incur all sorts of legal issues if the structure fails.


    After final inspection,
    Damaged/ Missing property discovered

   Common problem when a new home is bought.
 

  • When people leave, they try to get away with taking things with them i.e.
    - blinds, curtains, washing lines and
    - even fixed equipment like dishwasher etc.

  • - Conveyancer will activate legal proceedings to   ensure you       receive what is yours, or
    -Be entitled to some compensation to the value of the damaged or missing property.
